General Terms and Conditions for use of the ChaCha platform
§1 Scope
These General Terms and Conditions (AGB) apply to the use of the ChaCha platform (chachain.de, chacha.charity). The final text will be published following legal review.
The Terms address natural and legal persons who use the platform to process donation campaigns or to support charitable projects.
Deviating or supplementary conditions of users only become effective if ChaCha has expressly agreed to them in writing.
§2 Subject Matter
The subject matter of the usage agreement is access to the ChaCha platform and the use of the services offered thereon. The exact scope of services will be described in full after legal review is complete.
ChaCha provides a technical infrastructure that enables the connection between donors and non-profit organizations.

§3 Platform Services
ChaCha provides technical intermediary services between donors and non-profit organizations. Specific service descriptions will be listed here after legal review is complete.
The platform enables traceable and transparent processing of donation amounts. All transactions are documented in an audit-proof manner.
ChaCha reserves the right to expand, restrict or discontinue services if this is necessary in the interests of users and platform integrity.
§4 User Obligations
Users undertake to use the platform exclusively for lawful purposes and to comply with applicable laws, in particular German and European law.
Information on identity, contact details and means of payment must be truthful and complete. Users are obliged to update changes without delay.
Misuse of the platform, in particular for money laundering, terrorist financing or other illegal activities, is expressly prohibited.
§5 Donations and Payment Processing
Payment processing on the ChaCha platform is handled by the certified payment service provider Stripe. By using the payment function, you also agree to the Terms of Use of Stripe.
Donations are accepted and forwarded exclusively in Euro (EUR). The exact conditions for forwarding donations to beneficiary organizations will be published following legal review.
Tax-relevant receipts are provided within the scope of legal possibilities. A legal right to tax deductibility only exists for donations to recognized charitable organizations.
§6 Data Protection
The collection, processing and use of personal data takes place exclusively within the framework of applicable data protection laws, in particular the GDPR.

By using the platform, you agree to the processing of your personal data in accordance with our Privacy Policy.
§7 Liability
ChaCha is liable for damages caused by intentional or grossly negligent behavior by ChaCha or its legal representatives. The exact liability provisions will be published here following legal review.
For slight negligence, ChaCha is only liable for breach of essential contractual obligations and for damages resulting from injury to life, body or health.
Liability for indirect damages and loss of profit is excluded to the extent permitted by law.
§8 Right of Withdrawal
Consumers have a statutory right of withdrawal. The exact conditions and deadlines for the right of withdrawal will be listed here following legal review.
For voluntary donations: since donations are voluntary contributions without a claim to consideration, the conditions of withdrawal must be assessed separately. Details will be published following legal review.

§9 Changes to the Terms
ChaCha reserves the right to amend these Terms with reasonable notice. Users will be informed of material changes in good time, at least four weeks before they come into effect.
If a user does not object to the change within the set period, the amended Terms are deemed accepted. Users will be expressly notified of this in the change notice.
The right to extraordinary termination in the event of material changes remains unaffected.
§10 Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Place of jurisdiction will be determined following legal review (expected: Munich or Berlin).
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall not be affected. In place of the invalid provision, the legally permissible regulation that comes closest to the economic purpose of the invalid provision shall apply.
These Terms were last updated on 11 April 2026. The published version is binding for users upon completion of legal review.
